Calculating the Termination Date

Non-payment of rent - No less than 14 days after actual notice

Breach of Rental Agreement: Material breach - 30 days after actual notice

Breach of Rental Agreement: Criminal/drug/violent activity - 14 days after actual notice

No-Cause (No written rental agreement): Tenancy of two years or less - 60 days after actual notice

No Cause (No written rental agreement): Tenancy of two years or more - 90 days after actual notice

No Cause (Written rental agreement): Tenancy of two years or less - Notice must be given no less than 30 days before the rental agreement expires

No Cause (Written rental agreement): Tenancy of two years or more - Notice must be given no less than 60 days before the rental agreement expires

No Cause (Week to week rental) - No less than 7 days after actual notice

Other situations:

Rental property is being sold (written rental agreement) - No less than 30 days after actual notice

Shared residence (landlord lives on premises and shares common areas with tenant) Week to week rent - No less than 7 days after actual notice

Month to month rent -No less than 15 days after actual notice

A Notice of Termination of Tenancy does not have to be served on the tenant by a sheriff. Anyone can deliver it in hand to the tenant. The delivery in hand equals actual notice. A Notice can also be mailed, but you will need to add at least three days to the termination period.

Example:

Reason for termination is non-payment. Landlord hand delivers the Notice to the tenant on November 1. The Termination date allowed by law is November 15.

Landlord mails the Notice to the tenant on November 1st. The Termination date allowed by law is November 18th.
